Terms and Conditions of Sale and Use for the Larry Kit and Larry Application

1. Publisher Identification

The Larry App is published by LARRY SAS, a simplified joint-stock company registered with the Paris Trade and Companies Register under number R.C.S. Paris 934 406 760, with its registered office located at 55 bis boulevard Pereire, 75017 Paris (France).

These General Terms of Use (hereinafter "GTU") aim to define the terms and conditions under which LARRY SAS makes the Larry application (hereinafter "the Application") and associated services available to users (hereinafter "the User"); and the conditions under which the Larry Kit can be returned or exchanged.

2. Acceptance of the Terms of Use

Access and use of the application imply full and unreserved acceptance of these GTU.

By purchasing the Larry kit and by downloading, installing or using the Larry application, the User acknowledges having read these GTU and agrees to respect them.

LARRY SAS reserves the right to modify these GTU at any time. The applicable version is the one in force at the time of purchase of the Larry Kit.

3. Service Description

Larry is a physical Kit for iPad, operating with a dedicated application, which together allow transforming the iPad into an interactive activity book.

The Larry Kit includes:

  • a drawing clip
  • two paper-screens for 10 and 11-inch iPads
  • a connected stylus
  • a replacement nib

The Application notably offers:

  • a home page providing access to free content generated by artificial intelligence (AI) and categorized;

  • a "My notebook" section gathering the creations and activities made by the User;

  • templates and blank sheets for free drawing;

  • paid features, accessible via temporary subscriptions:

    • Pass Train-train: €5.99,

    • Pass Vacances: €8.99,

    • Pass-Partout: €69.99 (valid for one year).

During the subscription period, the User can generate an unlimited number of coloring pages, exercises and activities.

Generation services are made possible through third-party platforms (notably OpenAI, Gemini or equivalents).

LARRY SAS is not responsible for interruptions, malfunctions or errors attributable to these external platforms, nor for the quality of the generated content. LARRY SAS's responsibility is limited to proper technical configuration and the implementation of security measures aimed at preventing any inappropriate content.

4. Larry Kit Compatibility

The Larry Kit and its application are designed to work with Apple iPad tablets. Compatible models are as follows:

  • 10-inch iPad: iPad 07 (2019), iPad 08 (2020), iPad 09 (2021), iPad Air 3 (2019)
  • 11-inch iPad: iPad 10 (2022), iPad 11 (2024), iPad Air 4 (2020), iPad Air 5 (2022), iPad Air 6 (2024), iPad Air 7 (2025), iPad Pro 4 (2020), iPad Pro 5 (2021), iPad Pro 6 (2022), iPad Pro 7 (2024) 

5. Larry Kit Return and Exchange Conditions

The Larry Kit can be returned or exchanged under the following conditions:

  • The Kit has not been opened: the User must prove by means of a photograph that the box has not been opened and that the packaging remains intact. If applicable, the Kit will be returned at the User's expense to the following address:

    • Refund will be issued no later than 48 hours after receipt of the package.
  • The Kit has been opened and one of its components is defective: the User must then contact customer service, explain the material defect received and illustrate it with photographs. The elements will be replaced in whole or in part by Larry, after Larry's teams have tried to resolve the defect remotely.
    • If only part of the Kit's material needs to be replaced, LARRY SAS will do so at its own expense.
    • If the entire Kit needs to be replaced, the User is responsible for shipping it back to 208 rue du Gralet de Gargantua (01120 Divonne-les-Bains) and providing proof of payment. The return amount will be refunded by bank transfer within 48 hours of receipt of the package.

In accordance with point 2 of these General Terms of Use, the purchase of the Larry Kit implies acceptance that it is a product developed for Apple iPad. Consequently, incompatibility or the absence of a compatible iPad does not in any way entitle the User to return or exchange the Larry Kit.

6. Specific Application Features

The so-called "magic" feature allows transforming coloring pages into interactive quizzes or exercises.

This function is included in the subscription plans and automatically ceases to function upon expiration of the concerned subscription.

7. Third-party Content

The Larry Kiosk offers content provided by third-party publishers, including Auzou and the National Library of France (BNF).

This content is protected by copyright and remains the exclusive property of its respective publishers.

LARRY SAS has a limited distribution right restricted to the Larry Application.
Any unauthorized reproduction, representation, modification, publication or adaptation of this content outside the Application constitutes a violation of intellectual property rights and incurs the User's liability.

LARRY SAS prohibits any use of this content outside the Application or the associated official website.

8. User-Generated Content

Users can create and save their own content (drawings, texts, AI-generated creations) within the Application.

This content remains the property of the User.

However, by saving it in the Application, the User grants LARRY SAS a non-exclusive and free right of storage and display, exclusively for the purpose of service execution.

9. Intellectual Property

All elements constituting the Application (trademarks, texts, images, graphics, interfaces, sounds, software, general structure) are the exclusive property of LARRY SAS or its partners.

Any unauthorized reproduction, representation, modification, publication or adaptation is strictly prohibited and may lead to legal action.

10. Personal Data

LARRY SAS ensures the protection of its users' personal data in accordance with current legislation.

No nominative data is collected without explicit consent.
The only information retained concerns technical data necessary for the operation of the Application.

11. Liability

LARRY SAS undertakes to provide its services with diligence and professionalism.
However, LARRY SAS cannot be held responsible for:

  • service interruptions related to third parties;

  • data loss or damages resulting from inappropriate use of the Application;

  • content generated by AI or by the User;

  • indirect, material or immaterial damages resulting from the use of the Service.

The User remains solely responsible for their use of the application and the content they create or share.

12. Suspension and Termination

LARRY SAS reserves the right to temporarily or permanently suspend a User's access to the Application in case of abusive, fraudulent or unlawful use.

Subscriptions are not automatically renewed, unless explicitly stated in the corresponding offer.

11. Applicable Law and Competent Jurisdiction

These GTU are subject to French law.
In the event of a dispute, express jurisdiction is attributed to the courts of Paris, unless otherwise provided by law.
