Terms and conditions of use of LarryPad and the LarryPad app

1. Publisher

The LarryPad application is published by LARRY SAS, a simplified joint-stock company registered with the Paris Trade and Companies Register under number R.C.S. Paris 934 406 760, with its registered office at 55 bis boulevard Pereire, 75017 Paris, France.

These Terms and Conditions of Use (hereinafter “Terms”) govern access to and use of the LarryPad application (hereinafter “the Application”) provided by LARRY SAS.

2. Acceptance of the Terms

By downloading, installing, or using the Application, the user (“User”) acknowledges having read and accepted these Terms without reservation.
LARRY SAS reserves the right to modify these Terms at any time. The applicable version shall be the one in force at the time of use.

3. Description of the Service

Larry is a physical kit for iPad that works with a dedicated app, and together they transform the iPad into an interactive activity notebook.

The Larry Kit includes:

  • a drawing clip

  • two clipboards for 10- and 11-inch iPads

  • a connected stylus

  • a replacement tip

The Application includes:

  • a homepage featuring free AI-generated content organized by category;

  • a “My Notebook” section containing user creations and activities;

  • blank pages and templates for drawing;

  • paid features, available through temporary subscription plans:

    • Train-train Pass – €5.99

    • Holiday Pass – €8.99

    • All-Access Pass – €69.99 (valid for one year)

During the subscription period, the User may generate unlimited drawings, exercises, and activities.
These services rely on third-party platforms (including OpenAI, Gemini, and equivalent services).

LARRY SAS shall not be held liable for malfunctions, service interruptions, or inaccuracies arising from such third-party providers, nor for the quality of the generated content.
LARRY SAS’ responsibility is limited to maintaining proper technical integration and applying safety measures to prevent exposure to inappropriate content.

4. Compatibility of the Larry Kit

The Larry Kit and its app are designed to work with Apple iPad tablets. The compatible models are as follows:

10-inch iPad:
iPad 07 (2019), iPad 08 (2020), iPad 09 (2021), iPad Air 3 (2019)

11-inch iPad:
iPad 10 (2022), iPad 11 (2024), iPad Air 4 (2020), iPad Air 5 (2022), iPad Air 6 (2024), iPad Air 7 (2025), iPad Pro 4 (2020), iPad Pro 5 (2021), iPad Pro 6 (2022), iPad Pro 7 (2024)

5. Return or Exchange Conditions for the Larry Kit

The Larry Kit may be returned or exchanged under the following conditions:

  • If the Kit has not yet been shipped by LARRY SAS: In the event that a return request is made before the parcel is dispatched by LARRY SAS, LARRY SAS will simply cancel the order and issue a refund to the User.

  • If the Kit has not been opened:
    The User must provide proof, by means of a photograph, that the box has not been opened and that the packaging remains intact. In this case, the Kit must be returned at at the User’s expense to:

  • If the Kit has been opened and one of its components is defective:
    The User must contact customer service, explain the defect in the received equipment, and provide photographs as evidence. The components will be replaced in whole or in part by Larry, after Larry’s team has attempted to resolve the issue remotely.

  • If only part of the Kit needs to be replaced:
    LARRY SAS will cover the replacement costs.

  • If the entire Kit must be replaced:
    The User must return it to 55 bis Boulevard Pereire, 75017 Paris and provide proof of payment. The return shipping costs will be reimbursed by bank transfer within 48 hours at the latest after the parcel is received.

In accordance with section 2 of these General Terms of Use, purchasing the Larry Kit implies acceptance of the fact that it is a product developed for Apple iPad.

Consequently, incompatibility or the absence of a compatible iPad does not, under any circumstances, entitle the User to return or exchange the Larry Kit.

5. Specific Features

The “magic” feature allows the transformation of drawings into quizzes or interactive exercises.
It is available to subscribers and becomes inactive automatically upon the expiration of the relevant subscription.

6. Third-Party Content

The LarryPad Kiosk includes content supplied by third-party publishers, including Auzou and the Bibliothèque nationale de France (BNF).
Such content remains the exclusive property of the respective publishers and is licensed to LARRY SAS for use solely within the LarryPad application.

Any reproduction, distribution, or use outside the Application constitutes a breach of intellectual property rights and may result in legal action.
LARRY SAS shall not distribute this content outside its official platforms.

7. User-Generated Content

The User may create and store content (drawings, texts, AI-generated materials) within the Application.
These remain the property of the User.
However, by saving them within the Application, the User grants LARRY SAS a non-exclusive, royalty-free right to store and display such content solely for the purpose of providing the service.

8. Intellectual Property

All components of the Application, including trademarks, logos, texts, designs, interfaces, and software, are the exclusive property of LARRY SAS or its partners.
Any unauthorized reproduction, modification, or distribution is strictly prohibited and may result in legal proceedings.

9. Personal Data

LARRY SAS complies with all applicable laws on data protection.
No personal data is collected without the User’s explicit consent.
Only technical data necessary for the operation of the Application may be processed.

10. Liability

LARRY SAS endeavors to provide reliable and secure access to the Application.
However, the company shall not be held liable for:

  • service interruptions or failures caused by third-party providers;

  • data loss or damages resulting from misuse of the Application;

  • inaccuracies or errors in AI-generated content;

  • indirect, consequential, or immaterial damages resulting from the use of the Service.

The User remains solely responsible for their use of the Application.

11. Suspension and Termination

LARRY SAS reserves the right to suspend or permanently terminate access to the Application in case of misuse, fraud, or breach of these Terms.
Subscriptions are not automatically renewed unless otherwise specified.

12. Governing Law and Jurisdiction

These Terms are governed by French law.
Any dispute shall fall within the exclusive jurisdiction of the courts of Paris, subject to mandatory legal provisions.
